Social media has become an integral part of the internet and modern communication. We also use the social network and video portal TikTok, which is operated by the Chinese company Beijing Bytedance Technology Ltd. We would like to point out that you use the TikTok social media service offered here and its functions on your own responsibility. As the controller, TikTok collects personal data from you as a visitor when you visit our TikTok page, including through the use of cookies. We have no influence on the processing and further use of your data, as TikTok alone determines the processing. It is not possible for us to understand to what extent, where and for how long the data is stored, to what extent the data is linked and analysed and to whom the data is passed on. We also have no insight or influence with regard to deletion periods, i.e. whether and to what extent TikTok complies with deletion periods. Data processing by TikTok

We would like to point out that TikTok is responsible for collecting personal data from you when you visit our TikTok page.

This includes technical data such as device and network connection data when you access the platform. This is log file data, such as device model, your operating system, browser information, IP address and your system language and location information (e.g. country, state or city) based on your technical data (e.g. SIM card and IP address), but also data on your usage behaviour of the TikTok platform (e.g. content viewed, the duration and frequency of your platform use, how you contact other users, your search history, settings). The data is used by TikTok for advertising purposes (analysis, creation of personalised advertising), the creation of user profiles and for market research. Furthermore, your data may also be transferred to China, which is the sole responsibility of TikTok.

TikTok uses various tracking technologies for this purpose: Among other things, TikTok uses cookies, pixels and local storage to store information on your computer that is used to record and analyse your interactions with our TikTok channel and to recognise you later. You can find more detailed information on what data is collected by TikTok, for what purposes and on what legal basis in TikTok's privacy policy.

You have the option of restricting the processing of your data by TikTok in the privacy settings of your TikTok account and via the security settings.

Data processing by us

We operate our TikTok page for the purpose of informing you and communicating with you as a user and interested party of our offer. We process your personal data when you contact us via our TikTok channel by using the functions provided for this purpose (e.g. messages, comment function, posts) or by accessing the content provided by us (e.g. videos). If you contact us in this way, we process your directly visible personal data (usually: user name, profile picture, message content, including any photos contained therein, date and time of the interaction) to respond to your contact or to provide your desired content. We do not process any other personal data from your use of the service.

The operation of the TikTok profile, including the processing of users' personal data, is based on Art. 6 para. 1 lit. f GDPR to realise our legitimate interests in an information and interaction opportunity via TikTok for and with you as our users. Insofar as your message is aimed at the conclusion of a contract or concerns topics relating to the implementation of an existing contractual relationship, the legal basis for processing is also Art. 6 para. 1 sentence 1 lit. b GDPR. Further legal bases for data processing may arise in individual cases from Art. 6 para. 1 lit. a GDPR (consent) or Art. 6 para. 1 lit. c GDPR (legal obligation).

We use the analysis functions of TikTok Insights on our TikTok page. This provides us with anonymised statistics provided by TikTok, which give us statistical insights into the visitors to our TikTok page and their interactions with our TikTok page and its content. The statistics include the following information:

  • Number of: Video views, profile views, likes, comments, shares and subscribers.
  • Information on: Liked videos, total views of all videos, total likes of all videos, total comments, total shares, total watch time, average watch time, number of videos watched in full, total reach and reach by region.
  • Information on demographic characteristics (gender, region) and statistics on usage activities of people who follow our TikTok page (times when people are particularly active; videos that are popular with people who follow our TikTok page). We use these statistics to constantly improve our TikTok page and our posts and to better respond to the interests of our users. We cannot draw any conclusions about specific users from the statistics or link them to the data of our subscribers. The legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR, our legitimate interest corresponds to the purposes mentioned.

We generally only store your personal data until the respective purpose for which the data was collected has been achieved. We delete personal data if the purpose of the data processing has been achieved and there are no other legal reasons against deletion of the data, such as the existence of statutory retention periods. Such periods may arise, for example, from the German Commercial Code (HGB) or the German Fiscal Code (AO) and last from 6 to 10 years. If you have given us your consent for a processing operation, the data associated with the granting of consent will be stored until revoked or at the latest for the duration of the processing operation and after termination of the same within the scope of the statute of limitations. We store your personal data that we use as part of the provision and use of the TikToc service for the standard limitation period of 3 years.

We do not carry out automated decision-making including profiling in accordance with Art. 22 GDPR with the data collected via our TikTok page.

TikTok is operated by the Chinese company Beijing Bytedance. The controller for users in the EU/EEA is TikTok Technology Limited, Dublin/Ireland together with TikTok Information Technologies UK Limited, London/United Kingdom. When using our TikTok page, it cannot be ruled out that your personal data will be transmitted to other companies within the TikTok group of companies worldwide and processed there.

 

TikTok processes personal data within its own group structures in connection with the provision of the platform within and outside the EU/EEA. For example, TikTok states that it stores the data processed on the video platform in data centres in the USA, Malaysia and Singapore or makes data accessible to global group companies by means of remote access.

 According to TikTok, these data transfers are either based on adequacy decisions pursuant to Art. 45 GDPR (for third countries for which the European Commission has determined an adequate level of data protection, e.g. for data transfers to corporate groups based in Canada, the UK, Israel, Japan and South Korea). For data transfers to countries for which there is no adequacy decision, TikTok uses the EU standard contractual clauses pursuant to Art. 46 para. 2 GDPR see TikTok Privacy Policy (https://www.tiktok.com/legal/page/eea/privacy-policy/en)

For data transfers from us to TikTok, we have contractually agreed on the Jurisdiction Specific Terms of TikTok for data transfers to third countries - insofar as no adequacy decision pursuant to Art. 45 GDPR of the EU Commission exists the EU - by agreeing standard contractual clauses in accordance with Art. 46 para. 2 GDPR.

Where personal data are processed for direct marketing purposes, you also have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
