3. For what purposes and on what legal basis do we process personal data?

When you visit, use or contact us via Cargobull PartnerConnect and MyCargobull, we receive personal data from you. We process your personal data for the secure and stable operation of the Cargobull Partner Connect and MyCargobull portals. We also offer you additional functions, e.g. for contacting us or receiving additional information. Finally, we process your personal data for legal purposes such as §147 AO or criminal law requests.

In general, we process data on the following legal bases:
If you give us your express consent (Art. 6 para. 1 a GDPR), e.g. if you would like us to contact you directly, subscribe to our newsletter or receive personalized promotional offers tailored to you. To fulfill our contractual obligations (Art. 6 para. 1 b GDPR), e.g. if you purchase products from us. As a company, we are subject to various legal obligations (Art. 6 para. 1 c GDPR). For example, we are obliged to retain certain documents under tax and commercial law.

4. Will my data be transmitted to third parties?

In order for Schmitz Cargobull to be able to process your data in accordance with the purposes described above, it may be necessary for other recipients to be able to view and process your data.

 4.1 Recipients within the Schmitz Cargobull Group

In special cases, it may be necessary for us to process your data on a group-wide basis. However, data processing within the Schmitz Cargobull Group only takes place if we have legal permission to do so. This is the case, for example, if other companies of the Schmitz Cargobull Group work for us within the framework of order processing or if there is a legitimate interest in accordance with Art. 6 para. 1 f GDPR.

We delete personal data of the data subject as soon as the purpose of storage no longer applies and statutory retention periods do not prevent deletion.

You have the right to information, rectification, erasure, restriction of processing, objection to processing and data portability. If processing is based on your consent, you have the right to withdraw this consent with effect for the future.

6.2 Rights in data processing based on legitimate interest

In accordance with Art. 21 para. 1 GDPR, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Art. 6 para. 1 e GDPR (data processing in the public interest) or on Art. 6 para. 1 f GDPR (data processing to protect a legitimate interest). This also applies to profiling based on this provision. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

6.3 Rights in the case of direct advertising

If we process your personal data for direct marketing purposes, you have the right under Art. 21 (2) GDPR to object at any time to the processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
