3. For what purpose and on which legal basis do we process personal data?

We receive personal data about you when you browse our website or otherwise contact us.
We generally process this data based on the following legal basis:
If you provide your explicit consent (Art. 6 (1 a) GDPR), for example when you would like us to contact you directly, subscribe to our newsletter or receive promotional offers personalised to your needs.

To fulfil our contractual obligations (Art.6 (1 b) GDPR), for example, if you purchase products from us.
As a company, we are governed by various legal obligations (Art. 6 (1 c) GDPR). For example, we are required to retain certain documents in accordance with taxation law and commercial law. We also process data by virtue of a legitimate interest on our part or by third parties (Art. 6 (1 f) GDPR). This includes data processing for the purpose of direct marketing, sales promotion, IT security and to combat fraud, as well as to create pseudonymous user profiles for analysis and the user-led design of the website (tracking). You have the right to object to this data processing by virtue of our legitimate interest in accordance with Art. 21 (1) GDPR.

3.1 Data processing on our website

3.1.1 Contact with Schmitz Cargobull

Send your questions and messages to us via the contact form, our e-mail address or by phone. We only process your personal data to contact you in your preferred ways and to process your enquiry (the legal basis is Art. 6 (1 a or b) GDPR).

3.1.2 Dispatch of our newsletter

You can subscribe to our newsletter to receive information about the latest offers, new products etc. This can also include offers from the Schmitz Cargobull Group. Marketing information is only sent to your e-mail address within the remit of our newsletter if you have consented to the use of your e-mail address. Of course, you can revoke your consent to receive newsletters at any time by clicking on the unsubscribe link in the newsletter or informing us of your wish to unsubscribe by e-mail to info@cargobull.com. We use the double opt-in procedure for registration for our newsletter. This means that we send an e-mail to the specified e-mail address after registration in which we request confirmation that you wish to receive the newsletter. In addition, we store your IP addresses along with the date and time of registration and confirmation. This enables us to provide proof of your registration and, if necessary, resolve any possible misuse of your personal information by third parties.

3.1.3 Newsletter tracking

We analyse your user behaviour when distributing the newsletter to better understand how our newsletter is used. The e-mails sent contain web beacons, also known as tracking pixels, for the purpose of this analysis. These are one-pixel image files that link to our website and enable us to analyse your user behaviour. This is done through the use of web beacons linked to your e-mail address that have a unique ID. Links in our newsletters also contain them. We use this data to create a user profile to tailor the newsletter to your specific interests. In doing so, we record when you read our newsletter, the links you click on and derive your personal interests from this information. We link this data your activities on our website.
You can object to this tracking at any time by clicking on the separate link provided in every e-mail. The information will be stored for as long as you subscribe to the newsletter. After unsubscribing, we will only store the data anonymously for statistical purposes. This kind of tracking is not possible if you have disabled the display of images in your e-mail program by default. In this case, the newsletter will not be displayed completely and you may not be able to use all of its functions. The tracking described above is carried out if you manually view the images.

3.1.4 Other advertising by Schmitz Cargobull

When we receive your e-mail address and postal address with an order, we can use this data to inform you in future about similar product and service offers by e-mail and post. If you do not wish to receive any further marketing information by e-mail or post, you can object to the commercial use of your data at any time, effective for the future, without incurring any other costs than the basic rate of the transmission costs. 3.1.5 Careers

You can apply electronically, in particular by e-mail or via the Careers portal, to one of our companies. Your personal information will be used exclusively to process your application and will be processed initially by Schmitz Cargobull AG. Your application will then be forwarded to the company within the Schmitz Cargobull Group that is advertising for staff. Please note that unencrypted e-mails will not be transmitted in an access-protected manner.
If you have applied for a specific position and this position is no longer vacant or we regard you as suitable for, or better suited to, another position, we would be happy to forward on your application within the company. Please inform us if you do not consent to us forwarding your application.
Your personal data will be immediately deleted at the end of the application process or after a maximum of 6 months, unless you do not explicitly consent to longer storage of your information or we have concluded a contract with you. The legal basis for this is Art. 6 (1 a, b and f) GDPR as well as section 26 of the Federal Data Protection Act (BDSG). 3.1.6 How are cookies used on this website?

Cookies are stored on your computer when you use our website. Cookies are small text files assigned to and stored on your hard disk by the browser that you are using and from which the organisation that sets the cookie obtains certain information. Cookies cannot be used to execute programs or deliver viruses to your computer. They are simply used to make our online offering more user-friendly and effective. We also use cookies to identify you during subsequent visits if you have an account with us. Otherwise, you will need to log in each time you visit our website.
This website uses the following types of cookies, the scope and function of which are explained below:
Transient cookies

These cookies are automatically deleted as soon as you close your browser. They include, in particular, session cookies. They store a session ID, which enables various requests to be assigned to your browser during the shared session. This therefore enables your server to be recognised again when you return to our website. Session cookies are deleted when you log out or close your browser.
Persistent cookies

These cookies are automatically deleted after a specific time period, which can vary from cookie to cookie. You can delete cookies at any time via your browser security settings.

Flash cookies
The flash cookies used will not be recorded by your browser, but rather by your flash plug-in. We also use HTML5 storage objects that are stored on your device. They store the necessary data regardless of the browser used and have no automatic expiration date. 3.1.7 Website analysis

Matomo

We use the web analytics service software Matomo (formerly Piwik) (www.matomo.org), a service provided by InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand, ("Matomo"). Pseudonymised user profiles can be created, evaluated and cookies can be used. The data collected using Matomo technology (including your pseudonymised IP address) is processed on our servers. The information generated by the cookie in the pseudonymous user profile is not used to personally identify the visitor to this website and is not combined with personal data about the bearer of the pseudonym.

The legal basis is your consent in accordance with Art. 6 Para. 1 lit. a GDPR.[LP1] 

Before using Matomo, we obtain your consent when you enter our website. Your consent is voluntary and can be revoked at any time with effect for the future. If you wish to revoke your consent, simply change the settings on the cookie tool we provide on our website.

Google Analytics

We use the web analytics service Google Analytics, provided by Google LLC, (1600 Amphitheatre Parkway Mountain View, CA 94043, USA). For users in the EU/EEA and Switzerland the service is provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland.

The usage includes the Universal Analytics mode of operation. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous User-ID and thus to analyse the activities of a user across devices.

Google Analytics uses cookies that enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, due to the activation of IP anonymisation on this website, your IP address will be shortened by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there.

The personal data is transferred to the USA on the basis of EU standard contractual clauses of the European Commission. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage for the website operator. The data sent by us and linked to cookies or user IDs (e.g. user ID) are automatically deleted after 14 months. Data whose retention period has been reached is automatically deleted once a month.

Before using Google Analytics, we obtain your consent when you enter our websites. Your consent is voluntary and can be revoked at any time with effect for the future. If you wish to revoke your consent, simply change the settings on the cookie tool provided by us on our website.

Facebook Custom Audiences (Facebook pixels)

Within the framework of usage-based online advertising, we use the Custom Audiences service of Facebook Inc. (1601 S. California Avenue, Palo Alto, CA 94304, USA). For this purpose, we use the Facebook Ads Manager to define target audiences of users based on specific characteristics, who subsequently receive ads within the Facebook network.

Users are selected by Facebook based on the profile information they provide and other information provided through their use of Facebook. If a user clicks on an advertisement and then arrives on our website, Facebook receives information via the Facebook pixel integrated on our website that the user has clicked on the advertising banner.

In principle, a non-reversible and non-personal checksum (hash value) is generated from your usage data, which is transmitted to Facebook for analysis and marketing purposes. A Facebook cookie is set in the process. This records information about your activities on our website (e.g. surfing behaviour, sub-pages visited, etc.). In addition, your IP address is stored and used for the geographical distribution of advertising.

We do not use Facebook Custom Audiences via the customer list or the "extended comparison" function.

For further information on the purpose and scope of data collection and the further processing and use of data by Facebook, as well as your settings options for protecting your privacy, please refer to the Facebook data protection guidelines.

3.2 Data processing at trade shows

If you provide us with your contact information at a trade show, for example, by leaving your business card, participating in a contest (see 3.1.2) or subscribing to our newsletter (see 3.1.3.), we will record this data in our CRM system. We use your data to contact you as requested, establish a business relationship and provide you with information material.

3.3 Data processing with phone support

If you contact us by phone for support, we will collect your name, your company, your concern and, if need be, contact details for a call back, if we require this information to process your enquiry. Your data will be used to process your request. The legal basis for this is Art. 6 (1 b and f) GDPR. The call will only be recorded with your express consent (Art. 6 (1 a) GDPR). The recording is done to monitor and improve the quality of our customer support.

4. Will your data be transmitted to a third party?

To enable Schmitz Cargobull to process your data in accordance with the aforementioned purposes, it may also be necessary for other recipients to view and process your data.

4.1 Recipients within the Schmitz Cargobull Group

In special cases it may be necessary to process your data Group-wide. However, data is only processed within the Schmitz Cargobull Group if we have the legal permission to do so. This is the case, for example, if other companies within the Schmitz Cargobull Group work on our behalf when processing an order or if a there is a legitimate interest as per Art. 6 (1 f) GDPR.

4.2 External service providers (order processors)

Your data will be forwarded to Service Partners if they are working on our behalf and support Schmitz Cargobull in delivering its services. If, for example, you subscribe to our newsletter, we will task a service provider with the distribution of the mailing.
Processing of your personal data by authorised service providers is only done in connection with order processing as per Art. 28 GDPR.

4.3 Other service providers, partners and third parties

Schmitz Cargobull can work together with additional partners if this is necessary to deliver our services or if we are obliged by law to release data. We attach importance to processing your data within the EU. However, we may employ service providers from outside the EU. In these cases, we ensure that an adequate level of data protection is established prior to the transfer of your personal data. This means that standard EU contracts or an adequacy decision, such as the EU Privacy Shield, will be utilised to achieve a level of data protection comparable to the standards within the EU.

5. How long is your data stored?

We delete the personal data of the data subject as soon as the purpose of the storage no longer exists and statutory retention periods no longer prevent deletion.

6. What are your rights and how can you exercise them?

You have the following rights toward us with regard to personal data pertaining to you:

6.1 General rights

You have a right to access, correction, deletion, limitation of processing, objection to the processing and data transfer. Providing processing is based on your consent, you have the right to revoke this consent with effect for the future.

6.2. Rights governing data processing by virtue of a legitimate interest

In accordance with Art. 21 (1) GDPR, you have the right to object to the processing of data relating to you, that is processed pursuant to Art. 6 (1 e) GDPR (Data processing in the public interest) or Art. 6 (1 f) GDPR (Data processing to exercise a legitimate interest), at any time for reasons related to your specific situation. This also applies to profiling based on this regulation. If you exercise your right to object, we will no longer process your personal data, unless we can demonstrate compelling legitimate grounds for its processing that override your interests, rights and freedoms, or the processing is used to establish, exercise or defend legal claims.

6.3 Rights relating to direct marketing

If we process your personal data for direct marketing purposes, you have the right, in accordance with Art. 21 (2) GDPR, to object at any time to the processing of your personal data for such marketing purposes, including profiling, to the extent that this is related to direct marketing. We will no longer process your personal data for these purpose should you object to its processing for the purposes of direct marketing.

6.4 Rights to complain to a supervisory authority

You also have the right to lodge a complaint with a responsible data protection supervisory authority concerning our processing of your personal data.
